Florida Home Schools

Today more than ever, many families are choosing to educate their children at home rather than in a public or private school. This choice may be based on religious, moral or personal reasoning. Regardless of the reasons behind a familys choice to school its children at home, there are several laws people must be aware of as they begin to formally educate their child at home.

If you live in Florida, prior to deciding on schooling your children at home, you will want to familiarize yourself with Florida home schools laws. The first law you should read up on is: The Home Education Act of 1985. This law was introduced to provide home educators with a way to comply with compulsory school attendance laws.

The act has become part of the Florida Statutes - Chapter 232 which defines compulsory school attendance. In Section 232.02 you will find attendance may be achieved by having your child attend one of the following:

  • A public school
  • A parochial, religious or denominational school
  • A private school
  • A home education program

A home education program is described in the law as "sequentially progressive instruction of a student in his or her home by his or her parent or guardian" It is assumed the parent/guardian is the childs primary teacher or instructor in a Florida Home Schools setting. Instruction in areas such as athletics, field trips, music, art, advanced subjects are permitted and encouraged. Some homeschooling families join together to form co-ops to provide these experiences to their children without one family having to burden the entire cost.

While parents/guardians may join together to share resources in certain areas, Florida home schools laws do not allow parents/guardians to teacher children other than their own in their home on a daily basis. This type of consistent instruction would be equivalent to the instructing parent being viewed as a private tutor or creating a private school. Private tutors and instructor are subject to other laws outside of the Florida Home Schooling laws.
